2024 Insight Conference Attendee Terms and Conditions
Thank you for attending the 2024 Insight Tech Conference (the “Conference”) from September 15-17, 2024 at The Venetian Resort in Las Vegas, NV (the “Venue”). The Conference is provided by Trimble Transportation and its affiliates (“Trimble”). These terms and conditions (the “Terms”) apply to Conference attendees. These terms apply to all attendees at the Conference. You’ll need to agree to these terms and conditions in order to complete the registration process.
By acknowledging your acceptance of these Terms and submitting your registration, you accept, and knowingly and voluntarily agree to be bound by and abide by, these Terms.
CANCELLATION POLICY: CANCELLATION REQUESTS RECEIVED BY TRIMBLE ON OR BEFORE AUGUST 2, 2024 WILL RECEIVE A FULL REFUND. CANCELLATION REQUESTS RECEIVED BY TRIMBLE FROM AUGUST 3, 2024 THROUGH AUGUST 23, 2024 WILL RECEIVE A REFUND OF 50% OF THE PAID FEES. NO REFUND WILL BE PROVIDED FOR CANCELLATION REQUESTS RECEIVED BY TRIMBLE AFTER AUGUST 23, 2024. REQUESTS TO TRANSFER YOUR REGISTRATION TO ANOTHER ATTENDEE (“SUBSTITUTIONS”) WILL BE ACCEPTED THROUGH SEPTEMBER 16, 2024. You may modify or cancel your registration through the registration website using your confirmation number. All refunds will be processed in the same manner as the original payment.
Payment: Failure to pay any amounts when due, or chargeback or payment reversal of previously paid fees, will result in the cancellation of your Conference registration.
Health Requirements and Force Majeure: The health and well-being of our Conference participants is our highest priority. Recent years have shown that pandemics can be constantly evolving and give rise to new variants and changing public health requirements. Attendees will be required to comply with any health orders in effect at the time of the Conference and with all posted notices and signs during the Conference, such as but not limited to social distancing and masks. Trimble and its Conference partners and service providers will not be liable to you to the extent we are unable to carry out some or all of our obligations with respect to the Conference, including without limitation individual events and presentations, due to any cause beyond the reasonable control of Trimble, including without limitation: destruction of, or damage to the Venue; act of God or acts of public enemy; epidemic or pandemic; curtailment or restriction of transportation facilities or resources; strikes; protests; war or war-like conditions; or terrorist attack.
Use of Your Information: Information on how Trimble collects, processes and uses your information, including registration information and information provided to Trimble during the conference, is in the Trimble Privacy Notice available through the Trimble Privacy Center. Additional privacy terms apply to California residents. By submitting your registration information, you agree that Trimble, and its Conference partners and service providers, may use your information to send you event-related information, and to administer your participation in the Conference. If you register for or participate in an event sponsored, managed or operated by a Conference exhibitor or other third party, your registration information may be shared with those parties, and their processing and use of your information will be governed by their privacy policies. If you are an invited speaker, we may share your contact information, biographical information, and image/likeness with Conference attendees.
Trimble event co-sponsors, exhibitors, and other third parties may directly request your personal information at their exhibit booths or presentations. If you present your badge for scanning at an exhibit booth or during a presentation, the information associated with your badge will go to the recipient (e.g., the exhibitor, the Venue, etc.). If you choose to provide your information to a third party, you should first review their privacy policies to ensure you are comfortable with how they will treat your personal information.
Antitrust: The Conference expects attendees to strictly comply with applicable state and federal laws and industry antitrust policies that prohibit the exchange of information among competitors regarding matters relating to price, refusals to deal, markets division, tying relationships and other topics which might infringe upon antitrust regulations. Any such exchange or discussion during or in connection with the Conference is expressly prohibited.
Special Accommodations: Trimble values and supports attendees with disabilities and complies with the Americans with Disabilities Act. If you are a person with a disability in accordance with the Americans with Disabilities Act and would like to request a reasonable accommodation in connection with your attendance at the Conference, please contact Trimble to discuss your request.
Usage of photos/videos taken during the Conference: Trimble may document and record portions of the Conference, and may use social media to post real-time photos and videos and to display submissions to its social media feeds in the Venue. Attendees and sponsors are encouraged to capture and post their Conference experiences to their own social media, using the #insightexpo24 hashtag, provided you do not infringe on the rights of any third party (e.g., sponsors, other attendees, Trimble, etc.). By attending the Conference, you acknowledge and agree that (a) Trimble may use and edit audio, photos, and video it captures at the Conference for its marketing and promotional activities and for all other lawful purposes in the ordinary course of its business, in any form or medium now known or later developed, without compensation to you. Trimble disclaims all liability for any audio, images, and/or videos of you taken by other attendees, sponsors, or third parties during the Conference.
Liability Waiver and Release: In consideration of being allowed to register for, and participate in, the Conference, you hereby warrant and represent that you are 18 years of age or above, and you freely waive, release from liability, assume all risks, and covenant not to sue Trimble, its Conference partners and service providers, and their employees and personnel (the “Releasees”) for any expense, loss, damage, personal injury, including loss of life, illness, including but not limited to exposure to COVID-19, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after the Conference, unless said expense, loss, damage, personal injury, including loss of life, illness, disability, property damage or property theft or actions of any kind is caused solely by the Releasees’ gross negligence. Additionally, you agree that in no event will Trimble, the Venue, their partners and service providers, or their respective directors, employees, agents, and representatives be liable for any consequential, indirect, special, punitive or incidental damages of any nature or for any reason whatsoever whether or not apprised of the possibility of any such lost profits or damages. Further, you expressly acknowledge and agree that to the maximum extent provided under applicable law, Trimble’s maximum liability to you, or in any way related to, or in conjunction with, or arising from your attendance at the Conference, or judicial determination of Trimble’s wrongful cancellation of the Conference will be limited solely to the return of the Conference registration fee previously paid to Trimble by you. This Liability Waiver and Release is specifically binding upon your heirs and assigns and is knowingly given.
Attendee Conduct: We value the attendance of all participants in the Conference. All attendees are expected to behave in a considerate, respectful, inclusive and collaborative manner. Trimble prohibits harassment against any person for any reason. Harassment includes discrimination, offensive verbal comments, images, activities or other material, or bullying related to gender, gender identity and expression, age, sexual orientation, disability, physical appearance, body size, race, ethnicity, religion, technology choices, sexual images in public spaces, deliberate intimidation, stalking, following, harassing photography or recording, sustained disruption of talks or other events, inappropriate physical contact, and unwelcome sexual attention. Attendees (including exhibitors and sponsors) asked to stop any harassing behavior are expected to comply immediately.
If you are being harassed, notice that someone else is being harassed, or have any other concerns, please contact a member of the Conference or Venue staff immediately. Conference or Venue staff can be identified as they'll be wearing branded clothing and/or badges. Conference staff will be happy to help participants contact hotel/venue security or local law enforcement, provide escorts, or otherwise assist those experiencing harassment to feel safe for the duration of the conference. We value your attendance.
Violation of these Terms: If you violate these terms, Trimble, the Venue, and their partners and service providers may take any action they deem appropriate, including but not limited to providing you a warning or expelling you from the Conference without any refund of your registration fee.
Miscellaneous: Trimble reserves the right to change these Terms in its sole discretion upon notice to you by email using the email address you provided during registration. If one or more of the conditions outlined in these Terms should become invalid, the remaining conditions will continue to be valid and apply. You agree that any and all matters, compliance issues or questions not specifically covered or addressed in these Terms, and all interpretation of these Terms, will be subject to Trimble’s sole decision and determination. These Terms will be governed exclusively by, and enforced exclusively in accordance with, the laws of the State of Minnesota without regard to or application of its conflicts-of-laws provisions. Any controversy, claim or dispute arising out of or relating to these Terms and/or your participation in or inability to participate in Conference will be subject to the exclusive jurisdiction of the United States District Court for the District of Minnesota or any state court sitting in Hennepin County, Minnesota and each Party irrevocably consents to the jurisdiction and venue of said courts and waives any right to object thereto. EACH PARTY IRREVOCABLY AND UNCONDITIONALLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN ANY LEGAL ACTION, PROCEEDING, CAUSE OF ACTION OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE CONFERENCE.
The views expressed by any Conference attendee, speaker, exhibitor, or sponsor are not necessarily those of Trimble. All attendees, speakers, exhibitors, and sponsors are solely responsible for the content of all individual or corporation presentations, marketing collateral, and/or advertising.
